DMCA Copyright Policy for Avec Ou Sans Cash

Avec Ou Sans Cash ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the policy below regarding copyright infringement. We will respond to clear notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Avec Ou Sans Cash website or services, please notify our Copyright Agent as set forth below. Your notice must comply with the DMCA requirements.

Filing a DMCA Notice of Infringement

To file a DMCA notice of infringement, you must provide a written communication that includes substantially the following:

  3. Contact Information of the Complaining Party: Your full legal name, mailing address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature: The signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification

If you believe that material you posted on our site was removed or disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, your counter-notification must be a written communication provided to our Copyright Agent that includes substantially the following:

  • Identification of the material that has been removed: Identify the specific URL(s) where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your full legal name, mailing address, and telephone number.
  • A statement that you consent to the jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Avec Ou Sans Cash may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA infringement notice. If we do not receive notice from the original complaining party that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system within 10-14 business days of our receipt of your counter-notification, we may, in our sole discretion, restore the removed material.
